Trainwave provides a machine learning orchestration platform that allows users to run their code on our servers. You are responsible for submitting your code, managing your machine learning tasks, and ensuring the proper configuration and performance of your models and data.

3. Account and Eligibility

To use the Service, you must create an account and provide accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Payment and Credits

Credits System: Our platform operates on a pre-paid credits system. Before using any resources or running any machine learning jobs, you are required to purchase credits.

No Refund Policy: Once credits are purchased, they are non-refundable. You are responsible for monitoring your credit usage and ensuring that you have sufficient credits to complete your tasks.

Fees: Fees for our services are calculated based on resource usage, such as computing power, memory, and storage. The applicable rates and fees are displayed on our platform, and they are subject to change at our discretion.

5. Ownership of Submitted Materials

User Ownership: All data, code, algorithms, and other materials (collectively, "User Submissions") that you submit to the platform remain your sole property. Trainwave does not claim ownership of any intellectual property rights over your User Submissions.

License to Trainwave: By submitting your code or data to the platform, you grant Trainwave a limited, non-exclusive license to use, store, process, and transmit your User Submissions solely for the purpose of providing the Service to you.

6. Responsibility for User Submissions

No Warranty for Code Performance: You are fully responsible for the performance, functionality, and results of your code. Trainwave does not guarantee that your code will function as intended or be free of errors, nor are we responsible for identifying or correcting any issues.

Platform Availability: While we strive to maintain continuous availability of the Service, we cannot guarantee uninterrupted or error-free access to our platform. Downtime or service interruptions may occur due to maintenance or unforeseen technical issues.

7. Prohibited Activities

You agree not to use the Service to:

• Violate any local, state, national, or international law.
• Distribute viruses, malware, or any other harmful or destructive code.
• Engage in any activity that could harm the Service, Trainwave‘s infrastructure, or other users.

8. Limitation of Liability

To the fullest extent permitted by law, Trainwave, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, or use of the Service, even if advised of the possibility of such damages.

9. Disclaimer of Warranties

Trainwave provides the Service "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may terminate or suspend your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
